Trade-Related Court Cases Filed for Week of Aug. 4-10

The following lawsuits were filed at the Court of International Trade during the week of Aug. 4-10:

  • Topcon Positioning Systems challenging CBP's denial of a protest of the classification of surveying equipment, parts, and accessories. CBP classified the goods in HTS heading 9031 (3.5%). Topcon said the goods should have been classified under three duty free headings in heading 9015. Summons filed Aug. 5.
  • Trigger Point Technologies challenging CBP's denial of protests of the classification of "foam roller" massage equipment. CBP classified the goods in HTS subheading 9506.91.0030 (4.6%). Trigger Point says the goods should have been classified in subheading 9019.10.2050 (free). According to the summons, CBP found the product has "equal dual uses" and classified it under General Rule of Interpretation 3(c), but Trigger Point says the rollers do not have two equal uses and should be classified as massage equipment. Summons filed Aug. 6.
  • Doskocil Manufacturing Company challenging CBP's denial of protests of the classification of its toys. CBP classified them in headings 6307 and 4016 (4.3%). Doskocil (a pet care product company) says the toys should have all been classified in subheading 9503.00.0090 (free).

No appeals of Court of International Trade decisions were filed at the U.S. Court of Appeals for the Federal Circuit during the week of Aug. 4-10.
