China Aluminum Extrusions: Cooling Tower Fans Blades are 'Subassemblies' Exempt From AD/CV Duties

Fan blade assemblies imported by SPX Cooling that are meant to be installed in cooling towers are finished subassemblies and aren’t subject to antidumping and countervailing duties on aluminum extrusions from China (A-570-967/C-570-968), said the Commerce Department in a scope ruling issued July 25. As subassemblies, the fan blade assemblies can qualify for the exemption from AD/CV duties for finished goods, it said.

The fan blade assemblies imported by SPX Cooling consist of a blade made of hollow aluminum extrusions, with glass-filled polypropylene caps at both ends of the blade, a carbon steel blade shank to connect it to the hub, carbon steel balance weights, and stainless steel blade hardware. At the time of importation, the fan blade assemblies are ready for installation into a cooling tower by using two stainless steel bolts.

While the fan blade assemblies are parts meant for installation into a larger cooling tower, Commerce found that they are subassemblies and may be considered finished goods. They are fully and permanently assembled and are ready for installation at the time of entry, so they qualify for the exemption for finished goods, it said. Commerce also found that the fan blade assemblies include non-aluminum extrusion materials that aren’t just “extraneous” parts like fasteners, thus meeting the other requirement for the exemption.
