ABA Customs Committee Forming Subcommittee to Raise Issues With CBP

The American Bar Association's Customs Law Committee is considering creating a special, as-yet-unnamed subcommittee to collect, analyze, and present various issues to CBP, said Customs Law Committee Vice Chair Peter Quinter of GrayRobinson.

"One of the roles of the Customs Law Committee is to work with the federal government agencies regulating international trade, especially CBP, to improve its dual objectives of 'protecting the border and expediting legitimate trade,'" Quinter told us.

He said the subcommittee members will create a list of concerns or issues to present to CBP and then follow up with conference calls and probably a face-to-face meeting at CBP headquarters. "This is more effective than individual attorneys representing separate clients as the customs attorneys who regularly interact with CBP have numerous common issues," Quinter said.

Items being considered for presentation to CBP include:

  • Timeliness of the issuance of CBP Rulings.
  • Timeliness of the issuance of CBP decision on petitions.
  • NAFTA Origination Verification procedures.
  • Powers of Attorney requested by FP&F Officers.
  • CBP Notices of Detention and Seizure.
