China Hand Trucks: Ace Hardware Luggage Cart Not Subject to AD Duty Order

A luggage cart from Ace Hardware is outside the scope of the antidumping duty order on hand trucks from China (A-570-891), the Commerce Department said in a final scope ruling. While sharing several characteristics with subject merchandise, the luggage cart can’t be used to lift loads, as required by the language of the scope.

Ace Hardware’s product is a lightweight cart designed for travel that can carry about 66 pounds. The upper handle section can be folded into the lower base section for compact storage. The cart has two rubber wheels, two folding wings that can widen the platform, and a kickstand to provide stability when the cart is in an upright position.

Commerce said the cart met several criteria set forth in the language of the scope: it has a vertical frame, a handle, and two wheels. It also has a projecting edge. But the scope requires that “the projecting edge … slides under a load for purposes of lifting and/or moving the load.” The Ace Trading cart collapses when sliding under a load, so it can’t perform that function, and isn’t subject to the AD duty order on hand trucks from China, said Commerce.
