China Petroleum Wax Candles: Hannukah Candles Included in Scope of AD Duty Order

Hanukkah candles imported and sold by Rite-Lite all are covered by the antidumping duty order on petroleum wax candles from China (A-570-504), said the Commerce Department in an April 30 scope ruling.

According to Rite-Lite, its candles should be excluded because they only serve one purpose -- to fulfill Jewish religious law during the holiday. That use contrasts with the multiple uses in the petition. In having a single use, they are similar to birthday candles, which are excluded from the scope, Rite-Lite said. The candles also do not serve decorative or lighting purposes, and so are similar to utility candles.

But the AD duty order on petroleum wax candles doesn’t mention Hannukah, religious, or holiday candles, Commerce said. After the agency clarified the scope of the order in 2011 (see 11080221), the only remaining exclusions are birthday, figurine, and utility candles. Those exclusions have specific requirements for physical characteristics and expected uses, which the Hannukah candles do not meet, Commerce said. As such, Rite-Lite’s Hannukah candles are subject to AD duties, it said.
