China Kitchen Appliance Shelving and Racks: Beverage Refrigerator Shelving for Commercial Use In Scope
Steel shelving used in wine coolers, beverage coolers, and Americans with Disabilities Act-compliant cooling units fall within the scope of the antidumping and countervailing duty orders on kitchen appliance shelving and racks from China (A-570-941 / C-570-942), said the Commerce Department April 22. U.S. importer U-Line Corporation had requested the scope ruling, arguing the shelves fell outside of the scope because they are not for use in residential refrigerators. But according to the Commerce department, the end use of the racks is irrelevant, and the shelving met the dimensional criteria set forth in the scope.

U-Line said its steel shelving is configured for bottles and cans, and would not be used to store food. The shelving, and the cooling units into which it is placed, are not used in kitchens or recreational vehicles. According to U-Line, the orders require that shelving be used in residential refrigerators to be included in the scope.
The scope of the orders says nothing concerning the use of shelving or its location, however, and does not require that the refrigerators be for commercial use, said Commerce. And while the petition may have focused on shelving for residential refrigerators, the International Trade Commission’s report from the investigation said the scope is not limited to residential and recreational refrigerator shelving, it said. Because all of U-Line’s shelving met the dimensional requirements from the scope, it is included, Commerce said.
