ITA to Revoke Four Companies from China Diamond Sawblades, Frozen Shrimp AD Orders
The International Trade Administration is partially revoking antidumping duty orders on diamond sawblades (A-570-900) and frozen warmwater shrimp from China (A-570-893) as part of a Section 129 determination to implement the June 2012 findings of a World Trade Organization panel. The WTO panel had found against the ITA’s use of zeroing in the respective antidumping duty investigations (see 12060830). Effective March 22, the ITA is revoking the AD duty order on frozen warmwater shrimp from China for Allied Pacific Group, Yelin Enterprise, and Shantou Red Garden. The ITA also intends to revoke the AD duty order on diamond sawblades from China for Advanced Technology & Materials, but is currently prevented from doing so by court order.

To implement the WTO panel’s findings against zeroing, the ITA recalculated rates from the original investigations at issue without using zeroing methodology. The ITA's issued its results March 4. After reviewing the results of the recalculations, the U.S. Trade Representative directed the ITA to implement them as follows:

As the ITA excludes any company from an AD duty order if it finds a zero AD rate in the original investigation, the ITA is revoking the AD duty order on frozen warmwater shrimp from China for Allied, Yelin, and Shantou, effective March 22.
The ITA would have revoked the AD duty order on diamond sawblades from China for AT&M, but is prevented from doing so by a March 6 Court of International Trade temporary restraining order (see 13031423). The ITA will instead continue suspension of liquidation, but set the cash deposit rate for this company to zero, effective March 22. The agency already announced its intent to revoke for AT&M March 4, so will presumably do so when and if the court allows it.
