FWS Asks for Comments on Import/Export Declaration Form Changes for New User Fee Exemption
The Fish and Wildlife Service is asking for comments on changes to its Declaration for Importation or Exportation of Fish or Wildlife (Forms 3-177 and 3-177a) related to its new license fee exemption program. The changes to the forms were temporarily approved by the Office of Management and Budget in October on an emergency basis, but the short-term approval is set to expire April 30. Comments are due by March 15.

The user fee exemption allows businesses that possess a validated FWS import/export license to avoid payment of the designated port base inspection fee if it: (1) certifies that it will exclusively import or export nonliving wildlife that is not listed as injurious and does not require a permit or certificate under FWS regulations; (2) certifies that the shipments for import or export contains 25 or fewer wildlife parts and have a total value of $5,000 or less. Businesses that have had two wildlife shipments that were refused clearance are ineligible, as are licensees that have been assessed a civil penalty, issued a Notice of Violation, or convicted of a misdemeanor or felony violation involving wildlife import or export.
