China Aluminum Extrusions: Refrigerator/Freezer Trim Kits Within Scope of AD/CV Orders
Refrigerator/freezer trim kits made from extruded aluminum and imported by Meridian Products are within the scope of the antidumping and countervailing duty orders on aluminum extrusions from China (A-570-967 / C-570-968), the International Trade Administration said in a scope ruling. Meridian argued that the merchandise constitutes “finished goods kits,” and thus are excluded from the purview of the AD/CV duty orders. But relying on the language of the scope and past scope rulings, the ITA said the AD/CV duty orders on aluminum extrusions from China apply.

Meridian said that because the trim kits are “a packaged combination of parts that contain, at time of importation, all of the necessary components to assemble a complete frame to surround a refrigerator or freezer,” the merchandise falls within the “finished goods kit” exclusion contained in the scope. The importer compared the products to picture frames, which are specifically excluded from the scope.
The ITA, however, said the fact that the trim kits contain all necessary components for assembly at the time of importation does not exclude them from the scope. The trim kits are wholly made of aluminum extrusions, said the ITA, and the scope says the mere inclusion of fasteners and similar parts, and identification of end use in the product description, does not meet the “finished goods kit” exception. The trim kits are wholly made from aluminum extrusions, in contrast to excluded products like picture frames, and so fall within the scope of the AD/CV duty orders.
