ITA Extends All AD/CV, FTZ, Other Deadlines for 2 Days Due to Hurricane Sandy Closing

The International Trade Administration is tolling all Import Administration deadlines for two days as a result of the closure during Hurricane Sandy, it said in a memo dated Oct. 31. The day on which any submission to the Import Administration is due should be calculated under the regulations as usual, except with the addition of two days (including weekends and holidays), it said.

The two day extension applies to every proceeding before the Import Administration including:

  • Proceedings relating to foreign trade zones and statutory import programs
  • Actions in antidumping and countervailing duty proceedings, including ITA deadlines for preliminary/final determinations and results, and interested party deadlines for submission of questionnaire responses and briefs.

According to the ITA, the extension is essential because it is impossible for Import Administration to make up the time lost, and an attempt to do so would impose an unfair burden on parties to its proceedings. The ITA declined to offer extensions on a case-by-case basis, and instead is offering a blanket extension because of the effort it would take to determine which proceedings would require extensions.
