ITC Issues General Exclusion Order, C/D Orders Against Infringing Dimmer Light Switches
The International Trade Commission issued a general exclusion order barring unlicensed entry of dimmer light switches for home and commercial use that infringe patents held by Lutron Electronics, and set a bond of 100 percent of entered value of covered products during the period of Presidential review.1 The ITC also issued cease and desist orders prohibiting American Top Electric Corp., Big Deal Electric Corp., Elemental LED (d/b/a Diode LED), and Zhejiang Yuelong Mechanical and Electrical Co. from importing, selling, marketing, advertising, distributing, offering for sale, transferring (except for exportation), and soliciting U.S. agents or distributors for infringing products. All four of these respondents were found to be in default in the ITC’s investigation of certain lighting control devices including dimmer switches and parts thereof (337-TA-776).

1The U.S. Trade Representative, as delegated by the President, has 60 days to approve or disapprove the ITC’s action. During this period, the subject articles are entitled to enter the U.S. under bond, in an amount determined by the ITC.
