WCO-Recommended HTS Changes Scheduled for Jan 1 Listed

A Proclamation that will amend the Harmonized Tariff Schedule to implement hundreds of WCO-recommended tariff changes is currently pending Presidential signature. Once signed, it will be published in the Federal Register and will take effect on January 1, 2012 or 30 days after publication, whichever date is later. A list of these tariff changes, which affect many products, is provided below.

Agencies Hope for President’s Signature by Thanksgiving

Agencies involved with the Proclamation are trying to arrange for the President to sign it by Thanksgiving, so that the Proclamation can be published in the Federal Register no later than November 30 or December 1, thereby ensuring a January 1, 2012 effective date.

Even if that signing deadline is not met, and the Proclamation takes effect after January 1, affected government and trade members will still have 30 days after publication to implement the changes.

Upcoming HTS Changes Are due to WCO Recommendations

These tariff changes are needed to conform the U.S. Harmonized Tariff Schedule (HTS) to the World Customs Organization’s International Convention on the Harmonized Commodity Description and Coding System (Harmonized System, or HS) and HS Committee decisions. In addition, certain changes may be due to U.S. Customs and Border Protection (CBP) requests for additional tariff numbers to continue existing duty treatment for particular goods once the WCO changes are implemented.

HTS Changes Aim to be “Substantially Rate Neutral”

According to the International Trade Commission, as required by law1, these changes are required to be “substantially rate neutral.” As a result, any modification that would change a rate of duty must be consequent to, or necessitated by, the WCO- recommended nomenclature changes.

Many Products Affected, Including Food and Ag

54 chapters affected. WCO officials have stated that there were a total of 225 amendments (affecting 5,205 tariff numbers) for the 2012 international HS. For the U.S. HTS, the following chapters are affected by the 2012 WCO-recommended changes:

1, 2, 3, 4, 6, 7, 8, 9,10, 11, 27, 28, 29, 30, 37, 38, 41, 42, 44, 47, 48, 56, 58, 61, 62, 63, 64, 65, 68, 71, 73, 74, 76, 82, 84, 85, 87, 90, 91, 92, 93, 94, 95, 96, 98, and 99

Food and ag goods. A large number of changes were made to facilitate the use of the HS for the compilation of food security data and agriculture (including forestry and fisheries) statistics. The largest volume of such amendments arose from a single request by the Food and Agriculture Organization (FAO) for separate identification of food products in Chapters 1-21.

Diapers, biodiesel, batteries. The 2012 HS also creates a new heading for hygiene absorbent products, such as infant diapers, adult incontinence products, feminine sanitary products, etc. Currently, these products are classifiable in the international HS under headings 48.18, 56.01, 61.11 or 62.09 according to their constituent materials. However, as of January 1, 2012, these hygiene absorbent products, of any material, will fall in the 2012 international HS under heading 96.19.

According to the ITC's 2010, amendments of particular economic and technological importance include those providing separate identification in the international HS for biodiesel fuels, nickel-metal hydride batteries (used in hybrid motor vehicles), and lithium-ion batteries (used to power consumer electronics products).

2010 ITC report 99.9% accurate for chapters 1-97. In June 2010, the International Trade Commission issued its final report on the proposed 2012 HTS changes that will be made to align the U.S. HTS to the WCO’s January 1, 2012 tariff changes to the HS nomenclature.

Government sources state that the ITC’s 2010 report is 99.9% accurate when compared to the text of the pending Proclamation for HTS Chapters 1-97, which are both detailed to the 8-digit level. For these chapters, only some typos and glitches have been fixed.

However, a large number of conforming changes have been added since the 2010 report, especially in HTS Chapters 98 and 99, so that they align with the Chapters 1-97 changes.

COMPILED LIST OF HTS CHANGES

The below list is a compilation of the tariff number and note changes, along with associated explanatory language in the ITC’s 2010 report on the 2012 WCO-recommended HTS changes.

This information was previously presented in a series of eight ITT articles that were published in June 2011.2 Along with the ITC’s report, it is a useful guide until the Proclamation is published (at that time, the ITC could also post a “draft version” of the 2012 HTS.)

Amendments to HTS Section I, Chapters 1-5

The following are the recommended amendments to HTS Section I (Live Animals; Animal Products) covering chapters 1-5 (see report for full descriptions/details):

Chapter 1: Live Animals

  • Note 1(a) to Chapter 1 would be modified by deleting the expression “0301, 0306 or 3007;” and inserting “0301, 0306, 0307 or 0308;” in lieu thereof.
  • Subheadings 0101.10.00 through 0101.90.40 would be superseded by the following: 0101.21.00, 0101.29.00, 0101.30.00, 0101.90, 0101.90.30, and 0101.90.40.
  • Subheading 0102.10.00 would be superseded by the following: 0102.21.00, 0102.29, 0102.29.20, 0102.29.40, 0102.31.00, and 0102.39.00.
  • Subheading 0105.19.00 would be superseded by the following: 0105.13.00, 0105.14.00, and 0105.15.00.

This subheading does not cover video game consoles or machines operated by coins, banknotes, bank cards, tokens or by any other means of payment (subheading 9504.30).”
  • The article description to heading 9504 would be modified by deleting the expression, “Articles for arcade” and inserting “Video game consoles and machines, articles for arcade” in lieu thereof.
  • Subheading 9504.10 would be deleted.
  • The article description for subheading 9504.30.00 would be modified by deleting the expression, “bowling alley” and inserting “automatic bowling alley” in lieu thereof.
