China High Pressure Steel Cylinders: ITC Institutes Prelim AD/CV Injury Investigations

The International Trade Commission has announced the institution of antidumping and countervailing duty injury investigations regarding high pressure steel cylinders from China that are provided for in HTS subheading 7311.00.00.

These investigations are being instituted in response to a petition filed by Norris Cylinder Company of Longview, Texas.

ITC to Determine if U.S. Industry is Injured

The ITC is instituting these investigations to determine whether there is a reasonable indication that an industry in the U.S. is materially injured or threatened with material injury, or the establishment of an industry in the U.S. is materially retarded, by reason of imports from China of high pressure steel cylinders that are alleged to be sold in the U.S. at less than fair value and alleged to be subsidized by the Government of China.

ITC Must Reach Preliminary Injury Determination by June 24

Unless the International Trade Administration extends the time for initiation, the ITC must reach a preliminary determination in AD and CV duty injury investigations in 45 days or, in this case, by June 24, 2011. The ITC's views are due at the ITA within five business days thereafter, or by July 5, 2011.

ITA Will Initiate AD/CV Investigation if ITC Injury Found

If the ITC preliminarily finds injury, the ITA will initiate its investigations to determine whether there is dumping or countervailing, and if so, the margin of dumping and subsidy rate.
