Turkey Pasta: Prelim Results of AD Admin Review
The International Trade Administration has issued the preliminary results of the antidumping duty administrative review of certain pasta from Turkey (A-489-805) covering the period July 1, 2009 through June 30, 2010. Interested parties are invited to comment on these preliminary results.

ITA Preliminarily Finds Reviewed Company is Reseller, Not Producer
The ITA preliminarily finds that Marsan Gida Sanayi ve Ticaret A.S. was a reseller, not a producer, of the subject merchandise during the period of review. Because the producer of subject merchandise, Birlik Paz. San. ve Tic. A.S., had knowledge that the pasta it produced and sold to Marsan was destined for the U.S., the ITA preliminarily determines that application of the reseller policy is appropriate.
The ITA's “automatic assessment” regulation for resellers applies to entries of subject merchandise during the review period for which the reviewed companies did not know their merchandise was destined for the U.S. In such instances, the ITA instructs U.S. Customs and Border Protection to liquidate non-reviewed entries at the all-others rate if there is no rate for the intermediary or reseller involved in the transaction. CBP to Liquidate Marsan's Entries at All-Others Rate if Finalized
Because there was only a request for review of the reseller and not the producer, the ITA intends in its final results of review to instruct U.S. Customs and Border Protection to liquidate entries by Marsan at the "all others'' rate from the investigation of 51.49%, in accordance with the reseller policy.
Preliminary Results Not in Effect, May be Amended
These preliminary results are not in effect and may be amended. Any revised estimated AD cash deposit requirements will be effective upon publication of the final results of this administrative review for all shipments of the subject merchandise with a time of entry on or after the publication date.
