China Off-the-Road Tires: Final Results of CV Admin Review

The International Trade Administration has issued the final results of its countervailing duty administrative review of certain new pneumatic off-the-road tires from China (C-570-913) for the period of December 17, 2007 through December 31, 2008.

Final Results of Review

As a result of its review, the ITA determines that the following net subsidy rate exists for the period of review:

Estimated CV Cash Deposit Requirements

The ITA will instruct U.S. Customs and Border Protection to collect cash deposits for Starbright at the CV duty rate indicated above on all shipments of the subject merchandise with a time of entry on or after April 26, 2011.

The cash deposit rates for all companies not covered by this review are not changed by the results of this review, and remain in effect until further notice.

Assessment Instructions

The ITA will issue assessment instructions to CBP within 15 days after April 26, 2011. It will instruct CBP to liquidate shipments of subject merchandise by Starbright with a time of entry during the review period (except during the gap period as indicated below) at the net subsidy rate listed above.

CV Gap Period (April 15 - Sept 4, 2008)

For any entries of subject merchandise made during the gap period from April 15, 2008, through September 4, 2008, the ITA will instruct CBP to liquidate these entries without regard to CV duties.

(A gap period occurs when the period for which the CV suspension of liquidation may remain in effect before an order is issued has ended. The subject CV duty order became effective on September 5, 2008. See ITT's Online Archives or 09/05/08 news, 08090540, for BP summary.)
