Germany Lightweight Thermal Paper: Final Results of AD Admin Review
The International Trade Administration has issued the final results of its antidumping duty administrative review of lightweight thermal paper from Germany (A-429-840) for the period November 20, 2008 through October 31, 2009.

Final Results of Review
As a result of its review, the ITA determines that the following weighted-average margin percentage exists for the period of review. (Note that a liquidation injunction is in effect for subject merchandise produced and exported by Koehler. See assessment instructions below.)

Estimated AD Cash Deposit Requirements
The following estimated AD duty cash deposit requirements are effective for all shipments of subject merchandise with a time of entry on or after April 20, 2011:
- If the exporter is not a firm covered in this review, but was covered in a previous review or the original less-than-fair-value (LTFV) investigation, the cash deposit rate will continue to be the company-specific rate established for the most recent period;
- If the exporter is not a firm covered in this review, a prior review, or the LTFV investigation, but the manufacturer is, the cash deposit rate will be the rate established for the most recent period for the manufacturer of the subject merchandise; and
- If neither the exporter nor the manufacturer is a firm covered by this review, a prior review, or the LTFV investigation, the cash deposit rate will be 6.50 percent, the all-others rate established in the LTFV investigation.
Assessment Instructions for Koehler to be Issued When Prelim Injunction Lifted
Pursuant to a February 2009 preliminary injunction, the ITA has been enjoined from liquidating entries of the subject merchandise produced and exported by Koehler. Therefore, the ITA must continue to suspend liquidation of entries and does not intend to issue liquidation instructions to U.S. Customs and Border Protection for such entries until the preliminary injunction is lifted. Automatic Assessment Instructions for Intermediaries
The ITA also adds that it clarified its “automatic assessment” regulation on May 6, 2003, which will apply to entries of subject merchandise during the review produced by the respondent for which it did not know its merchandise was destined for the U.S. In such instances, the ITA will instruct CBP to liquidate unreviewed entries at the all-others rate if there is no rate for the intermediate company(ies) involved in the transaction.
