China and Taiwan Optical Brightening Agents: ITC Institutes Prelim AD Injury Investigations
The International Trade Commission has announced the institution of antidumping duty injury investigations regarding certain stilbenic optical brightening agents from China and Taiwan that are provided for in HTS subheading 3204.20.80.

This investigation is being instituted in response to a petition filed by Clariant Corporation, Charlotte, NC.
ITC to Determine if U.S. Industry is Injured
The ITC is instituting these investigations to determine whether there is a reasonable indication that an industry in the U.S. is materially injured or threatened with material injury, or the establishment of an industry in the U.S. is materially retarded, by reason of imports from China and Taiwan of stilbenic optical brightening agents that are alleged to be sold in the U.S. at less than fair value.
ITC Must Reach Preliminary Injury Determination by May 16
Unless the International Trade Administration extends the time for initiation, the ITC must reach a preliminary determination in AD and CV duty injury investigations in 45 days or, in this case, by May 16, 2011. The ITC's views are due at the ITA within five business days thereafter, or by May 23, 2011.
ITA Will Initiate AD Investigation if ITC Injury Found
If the ITC preliminarily finds injury, the ITA will initiate its investigation to determine whether there is dumping, and if so, the margin of dumping.
