UAE Steel Nails: ITC Institutes Prelim AD Injury Investigation
The International Trade Commission has announced the institution of an antidumping duty injury investigation regarding certain steel nails from the United Arab Emirates that are provided for in HTS subheadings 7317.00.55, 7317.00.65 and 7317.00.75.

This investigation is being instituted in response to a petition filed by Mid Continent Nail Corporation of Poplar Bluff, Missouri.
ITC to Determine if U.S. Industry is Injured
The ITC is instituting these investigations to determine whether there is a reasonable indication that an industry in the U.S. is materially injured or threatened with material injury, or the establishment of an industry in the U.S. is materially retarded, by reason of imports from the UAE of certain steel nails that are alleged to be sold in the U.S. at less than fair value.
ITC Must Reach Preliminary Injury Determination by May 16
Unless the International Trade Administration extends the time for initiation, the ITC must reach a preliminary determination in AD and CV duty injury investigations in 45 days or, in this case, by May 16, 2011. The ITC's views are due at the ITA within five business days thereafter, or by May 23, 2010.
ITA Will Initiate AD Investigation if ITC Injury Found
If the ITC preliminarily finds injury, the ITA will initiate its investigation to determine whether there is dumping, and if so, the margin of dumping.
