China Tissue Paper: Prelim Affirmative AD Circumvention Determination for Vietnam Co.
The International Trade Administration has issued an affirmative preliminary determination that certain tissue paper products produced and/or exported to the U.S. from one Vietnamese company are circumventing the antidumping duty order on tissue paper from China (A-570-849), and will be subject to duties.

The ITA initiated this circumvention inquiry to determine whether imports of tissue paper products, produced and/or exported by Max Fortune (Vietnam) Paper Products Company, Limited (MFVN) to the U.S., are made from jumbo rolls and/or cut sheets of tissue paper produced in China, and whether such products are circumventing the AD duty order on tissue paper from China.
Tissue Paper Produced in China, Processed by MFVN is Circumventing China Order
The ITA preliminarily concludes that the process of converting the jumbo rolls and/or cut sheets of tissue paper into the finished tissue paper products in Vietnam is minor or insignificant, and that the value of the jumbo rolls and/or cut sheets produced in China is a significant portion of the total value of the finished tissue paper products MFVN exported to the U.S.
Therefore, the ITA preliminarily determines that exports to the U.S. of tissue paper products produced from China-origin jumbo rolls and/or cut sheets and further processed in Vietnam by MFVN constitute circumvention of the AD duty order on tissue paper from China.
Liquidation Suspended on All MFVN Entries on/After Mar 29, 2010
The ITA will direct U.S. Customs and Border Protection to suspend liquidation on all unliquidated entries of tissue paper produced and/or exported by MFVN with a time of entry on or after March 29, 2010, the date of the initiation of this inquiry.
AFA Cash Deposit of 112.64% Required for MFVN Entries on/After Mar 29, 2010
The ITA will also instruct CBP to require a cash deposit at the China-wide entity rate of 112.64% on all unliquidated entries of tissue paper produced and/or exported by MFVN with a time of entry on or after March 29, 2010, as the ITA concludes that the application of adverse facts available (AFA) is warranted.
