APHIS Asks for Comments for its Lacey Act Declaration Review

The Animal and Plant Health Inspection Service is requesting comments from the public by April 14, 2011 to assist it in its review of the implementation of the Lacey Act Declaration requirements for imported plants and plant products. Once this review is completed, APHIS will submit a report to Congress detailing its results.

The review is required to evaluate the effectiveness -- in terms of enforcement -- of the information in the declaration, including the requirement to list all possible countries if the country of harvest is unknown, or all possible species if the exact species that may have been used is unknown.

In addition, APHIS must assess the potential to harmonize the declaration requirements with other import regulations, recommend legislation, and after the review is completed, consider the need for regulatory revision.
