China Butt-Weld Pipe Fittings: AD Scope Now Excludes Structural Applications
The International Trade Administration is amending a final antidumping duty scope ruling regarding carbon steel butt-weld pipe fittings from China (A-570-814) to exclude fittings used only in structural applications, pursuant to a court ruling.

CIT Upheld Remand Redetermination Excluding Structural Applications
The Court of International Trade sustained the ITA's results of redetermination on remand that excluded from the scope of the AD order products that are imported and used only in structural applications.
Because there is now a final CIT decision, the ITA is amending its final scope ruling and now finds that the scope of the order excludes carbon steel butt-weld pipe fittings used only in structural applications.
The Federal Register notice announcing this change lists an effective date of January 16, 2011. (Note that the CIT sustained the ITA’s redetermination on January 6, 2011.)
Zero AD Cash Deposit Rate for Excluded Fittings
The ITA will instruct U.S. Customs and Border Protection that the AD cash deposit rate on carbon steel butt-weld pipe fittings used only in structural applications will be zero percent.
(In the event the CIT’s ruling is not appealed or, if appealed, upheld by the court, the ITA will instruct CBP to liquidate entries of carbon steel butt-weld pipe fittings from China used only in structural applications without regard to AD duties, and to lift suspension of liquidation of such entries.)
