AD: China, Korea Diamond Sawblades and Parts Thereof

The International Trade Administration is issuing antidumping duty orders on diamond sawblades and parts thereof from China and Korea.

ITA Issues AD Duty Orders Pursuant to Court Order

In February 2009, the ITA issued a "Timken"1 notice of a Court of International Trade (CIT) decision not in harmony with the International Trade Commission's final negative injury determinations in these AD duty investigations, which the ITC issued after the ITA's final affirmative AD duty determinations, and terminated the investigations.

Upon court-ordered remand in Diamond Sawblades Mfrs. Coalition v. U.S., the ITC issued an amended determination that an industry in the U.S. is threatened with material injury by reason of imports of diamond sawblades and parts thereof from China and Korea, which the CIT affirmed in January 2009. DSM Coalition filed a petition for a writ of mandamus compelling the ITA to issue AD duty orders and require collection of cash deposits in the respective investigations. Therefore, in September 2009, the CIT ordered the ITA to immediately issue and publish AD duty orders and collect cash deposits covering imports of diamond sawblades from China and Korea.

AD Suspension of Liquidation Instructions

The ITA previously instructed U.S. Customs and Border Protection to suspend liquidation for all entries of subject merchandise with a time of entry on or after January 23, 2009. Therefore, the ITA is instructing CBP to continue the suspension of liquidation from January 23, 2009.

AD Cash Deposit Requirements

Because suspension of liquidation is already in effect, the ITA will direct CBP to collect cash deposits on all unliquidated entries of diamond sawblades from China and Korea, as of January 23, 2009, for the exporter/producer combinations listed below at the following AD duty rates:

1In its decision in Timken Co. v. U.S., the Court of Appeals for the Federal Circuit (CAFC) held that the ITA must publish a notice of a court decision that is not "in harmony" with an ITA determination and must suspend liquidation of entries pending a "conclusive" court decision.
