CBP CSMS Messages and Web Postings

CBP has issued a memorandum announcing that the first tranche for the fiscal year 2010 specialty sugar tariff rate quota that opened on October 20, 2009 oversubscribed at opening moment. The pro rata percentage is 40.84258% or 0.4084258. Entries or withdrawals for consumption for specialty sugar presented after the opening should be returned to the broker for amendment.

1. 1st Tranche of Specialty Sugar TRQ Oversubscribed at Opening

The importer has the option to distribute the prorated allocation on a given entry (i.e., more or less than the prorated amount, or none at all). The importer may also transfer the allotment to entries at another port. However, in any of these scenarios, the importer may not enter more than the total prorated amount that was properly presented at opening. 2. Oct 29th Opening of 180-Day Special Import Quota for Upland Cotton

CBP has posted a memorandum announcing a special import quota of 13,470,353 kg for upland cotton that is provided for in HTS Chapter 99, Subchapter III, U.S. Note 6 and is entered under HTS 9903.52.68. (CBP notes that this quantity is not subject to the tariff rate quotas in Chapter 52 Additional U.S. Notes 5 through 10.)

The quota period is October 29, 2009 - April 26, 2010; to be counted under this quota, the cotton must be imported during this period and purchased not later than January 26, 2010. The opening date is October 29, 2009. 3. Updated TRQ/TPL "Threshold to Fill" List

CBP has posted an updated version of its TRQ/TPL "threshold to fill" list, a quick reference to monitor TRQs and TPLs that are approaching the restraint limit or have filled the in-quota (low) rate. The list is divided into two sections - those that are at least 85% filled and those that are closed. 4. Port of Roosville Upgraded to Commercial Processing Facility

CBP has announced that the Port of Roosville will be upgraded from a permit port to a commercial port on November 1, 2009. Roosville, located north of Eureka, will join Sweetgrass and Raymond as commercial ports in Montana. 6. CBP Messages on AD and CV Duty Actions

The antidumping and countervailing messages CBP issues on behalf of the International Trade Administration are now only available on CBP's Web site at http://addcvd.cbp.gov. AD and CV ABI administrative messages are no longer issued.
