DDTC Requests Comments on New Electronic Commodity Jurisdiction Form

The Directorate of Defense Trade Controls has issued a notice requesting comments on the electronic version of the DS-4076 Commodity Jurisdiction determination form.

Comments are due by October 28, 2009.

(The purpose of a commodity jurisdiction request is to determine whether an item or service is covered by the U.S. Munitions List and therefore subject to export controls administered by the State Department pursuant to the Arms Export Control Act and the International Traffic in Arms Regulations.)

DS-4076 May Now be Completed in PDF Format, Electronic Submission at Future Date

The revised DS-4076 can now be filled out in PDF format, and as of September 30, 2009, is available for use at http://pmddtc.state.gov/docs/DS4076.pdf.

Applicants have the option of using the DS-4076 or continuing to prepare letter-type submissions. The DS-4076 will be processed as a paper document, similar to the current letter-type submissions, with appropriate attachments and copies. At a future date, the DS-4076 will go electronic and at the time, all CJs will be submitted using the DS-4076 electronically.

DDTC states that applicants should not send the DS-4076 via email or on a CD at this time as it will not be accepted. DDTC will make a future announcement when it is able to accept the new form electronically.

(According to DDTC's Office of Management and Budget information collection request, there are no changes to or differences between the paper DS-4076 and the electronic DS-4076.)
