The next phase of the Animal and Plant Health Inspection Service's enforcement of the Lacey Act declaration requirement for imported plants and plant products - Phase III - begins on October 1, 2009.

APHIS Revised its Enforcement Schedule in Early September
On September 1, 2009, APHIS announced revisions to Phase III and Phase IV of its enforcement schedule, which eliminated a number of headings from Phase III and added a number of headings to Phase IV. As a result, Phase III will only extend enforcement to five more Chapter 44 Headings (Wood and Articles of Wood).
APHIS' current Lacey Act Declaration enforcement schedule is as follows:

APHIS Seeks Comments on Applying Declaration to Additional Products, Etc.
APHIS is still seeking comments by November 2, 2009 on the applicability of the declaration requirement to (1) certain HTS subchapters currently under consideration for subsequent phases and (2) additional products not currently under consideration for subsequent phases and not included in the revised phase-in schedule.
APHIS is also seeking comments on a number of other topics, including the use of blanket certifications, allowing the use of 'shorthand' group designations, etc.
