CV: Vietnam Polyethylene Retail Carrier Bags

The International Trade Administration has made a preliminary affirmative determination that countervailable subsidies are being provided to producers and exporters of polyethylene retail carrier bags (PRCBs) from Vietnam.

This is the first time a product from Vietnam has been the subject of a CV investigation. The ITA is also conducting an antidumping duty investigation on PRCBs. The preliminary AD determination is expected to be issued by October 27, 2009.

CV Suspension of Liquidation

The ITA is directing U.S. Customs and Border Protection to suspend liquidation for CV purposes of all entries of PRCBs from Vietnam (except for PRCBs both produced and exported by Advance Polybag Co., Ltd. (API), which has a de minimis rate), with a time of entry on or after September 4, 2009.

CV Cash Deposit Requirement

The ITA is also directing CBP to require a cash deposit or bond for CV duty purposes for entries of PRCBs from Vietnam with a time of entry on or after September 4, 2009, at the following CV duty rates:

(a) The ITA has determined a de minimis CV duty rate of 0.20% for API; therefore, no CV cash deposit is required for PRCBs produced and exported by API.

Final CV Duty Determination Aligned with Final AD Duty Determination

The ITA is also aligning the final CV duty determination with the final determination in the companion AD duty investigation of PRCBs from Vietnam. The final CV duty determination will be issued on the same date as the final AD duty determination, which is currently scheduled to be issued no later than January 11, 2010, unless postponed.
