AD: Thailand Certain Frozen Warmwater Shrimp
The International Trade Administration has issued the preliminary results of an antidumping duty changed circumstances review of certain frozen warmwater shrimp from Thailand.

This review was initiated to consider whether it is appropriate to revoke the order with respect to two companies, Phatthana Frozen Food Co., Ltd. (PFF) and Sea Wealth Frozen Food Co., Ltd.
(In the Section 129 implementation of this AD duty order, the ITA previously found a de minimis AD duty rate for the Rubicon Group, which includes the following nine companies: Andaman Seafood Co., Ltd., Chanthaburi Frozen Food Co., Ltd., Chanthaburi Seafoods Co., Ltd., Intersia Foods Co., Ltd., Phatthana Seafood Co., Ltd., S.C.C. Frozen Seafood Co., Ltd., Thailand Fishery Cold Storage Public Co., Ltd., Thai International Seafoods Co., Ltd., and Wales & Co. Universe Limited, and therefore the Rubicon Group was excluded from the AD duty order.
Although PFF and Sea Wealth were not included in the ITA's original margin calculations, the ITA has treated them as part of the Rubicon Group in subsequent segments of the proceeding.)
PFF & Sea Wealth Preliminarily Part of Rubicon Group, to be Revoked If Final
The ITA preliminarily determines that the Rubicon Group in its current form, including PFF and Sea Wealth, is the successor-in-interest to the Rubicon Group as it existed during the period of investigation in the AD investigation.
Thus, if these preliminary results are adopted in the ITA's final results of this changed circumstances review, it will consider PFF and Sea Wealth to be part of the Rubicon Group and, therefore, revoke them from the AD duty on certain frozen warmwater shrimp from Thailand.
The ITA will issue its final results of this review no later than December 21, 2009.
