CV: China Certain Tow-Behind Lawn Groomers and Certain Parts Thereof

CV Suspension of Liquidation Instructions

CV suspension of liquidation continues for entries of subject merchandise from China with a time of entry on or after November 24, 2008 through March 23, 2009. (The ITA instructed U.S. Customs and Border Protection to discontinue the CV suspension of liquidation beginning March 24, 2009.)

The ITA will direct CBP to reinstitute the CV suspension of liquidation for entries of lawn groomers from China (except Princeway, which has been assigned a de minimis CV duty rate) with a time of entry on or after July 31, 2009 (the date of publication of the ITC's final injury determination).

Entries of Subject Merchandise During Gap Period Are Not Liable for CV Duties

Entries of subject merchandise from China with a time of entry during the "gap period," on or after March 24, 2009 through July 30, 2009, are not liable for the assessment of CV duties.

CV Cash Deposit Requirements

The ITA will also instruct CBP to require, at the same time as importers would normally deposit estimated duties, CV duty cash deposits at the rates specified below (which are unchanged from the final CV duty determination) for entries of subject merchandise (except by Princeway) with a time of entry on or after July 31, 2009:

(a) The ITA continues to find a de minimis CV duty rate of 0.56% for Princeway; therefore, no CV duty cash deposit is required.
