CBP CSMS Messages and Web Postings

U.S. Customs and Border Protection has issued notice that a temporary restraining order implemented in November 2008 and converted into a preliminary injunction, has been preventing CBP from making timely distribution of funds available in fiscal year 2008 for Certain Frozen Warmwater Shrimp and Prawn from Ecuador, Brazil India, Thailand, Vietnam, and China (case numbers A-331-802, A-351-838, A-533-840, A-549-822, A-552-802, and A-570-893). However, on May 15, 2009 the Court of International Trade dismissed the injunction. Customs is currently processing distributions related to these cases, and distribution will be made as soon as possible. Claims remain subject to verification and audit by appropriate parties. 2. Weekly TRQ/TPL Commodity Report as of May 18th

CBP has issued its weekly tariff rate quota (TRQ) and tariff preference level (TPL) commodity report as of May 18, 2009. This report includes TRQs on various products such as beef, sugar, dairy products, peanuts, cotton, cocoa products, tobacco, certain BFTA, DR-CAFTA, Israel FTA, JFTA, MFTA, OFTA, SFTA, UAFTA (AFTA) and UCFTA (Chile FTA) non-textile TRQs, etc. Each report also includes the AGOA, ATPDEA, BFTA, DR-CAFTA, CBTPA, Haitian HOPE, MFTA, NAFTA, OFTA, SFTA, and UCFTA TPLs and TRQs for qualifying apparel and/or other textile articles, the TRQs on worsted wool fabrics, etc. (dated 05/18/09, available at http://www.cbp.gov/linkhandler/cgov/trade/trade_programs/textiles_and_quotas/commodity/cr05182009.ctt/cr05182009.pdf )

3. Updated TRQ/TPL "Threshold to Fill" List

CBP has posted an updated version of its tariff rate quota/tariff preference level "threshold to fill" list, a quick reference to monitor TRQs and TPLs that are approaching the restraint limit or have filled the in-quota (low) rate. The list is divided into two sections - those that are at least 85% filled and those that are closed. 4. CBP Private Aircraft Electronic Manifest Requirements Scheduled to Begin May 18th

On May 18, 2009, CBP was scheduled to begin requiring advance passenger and pilot information on private aircraft entering and departing the United States. The CF 1400 (Record of Vessel in Foreign Trade Entrances) electronic query report of the Vessel Management System (VMS), in accordance with 19 CFR 4.95, organized by entrances, has been updated as of May 18, 2009. 7. CF 1401 Query Report Updated
