(This chapter contains a PG data set that is designed for two purposes: (1) to begin the development of a universal Participating Government Agency data set; and (2) to allow CBP to meet the data collection [declaration] requirements as determined by the Lacey Act. See ITT's Online Archives or 02/19/09 news, 09021905, for BP summary of CBP posting this chapter, with additional chapter details.)

Intended Use Code, Description are Now Optional

The PGA chapter has been updated to remove the requirement for the filer to submit the Intended Use Code and Intended Use Description for Lacey Act reporting purposes. CBP sources state that the trade has the option of filing these data elements.

The removal of this requirement is denoted by deleted the "*" before the "Intended Use Code" and "Intended Use Description" data elements. (Data elements marked with a "*" are required for Lacey Act reporting purposes.)

(APHIS officials recently announced that PPQ Form 505 (Plant and Plant Product Declaration Form) has been revised to state that for the "description of the merchandise" field, the use of the merchandise is not required if it is unknown. See ITT's Online Archives or 03/20/09 news, 09032005, for BP summary.)

(See ITT's Online Archives or 04/02/09 news, 09040245 3, for BP summary of CATAIR Amendment 37, which includes changes to the PGA chapter.

See ITT's Online Archives or 03/30/09 news, 09033005, for BP summary of enforcement of Lacey Act declaration for certain items being delayed until May 1, 2009.)
