AD: China Wooden Bedroom Furniture

The International Trade Administration has issued a "Timken" notice of a Court of International Trade (CIT) decision not in harmony with the ITA's final affirmative antidumping duty determination for wooden bedroom furniture from China.

(In January 2009, the CIT sustained the final remand determination made by the ITA pursuant to the CIT's remands of the amended final determination of the AD investigation of wooden bedroom furniture from China.)

Certain AD Cash Deposit Rates to be Amended If CIT Decision Not Appealed or Is Upheld

If the CIT's decision is not appealed or is upheld, the ITA would issue an amended final determination with the following revised cash deposit instructions:

Company
Rui Feng Woodwork Co., Ltd.; Rui Feng Lumber Development Co., Ltd.; and Dorbest Limited (collectively, Dorbest)
Lung Dong Furniture Co., Ltd./Dongguan Dong He Furniture Co., Ltd.
Shing Mark Enterprise Co., Ltd.
\"Separate Rate\" Companies (only those who have no superseding rate1)

(Note that Shanghai Starcorp Furniture Co., Ltd., Starcorp Furniture (Shanghai) Co., Ltd., Orin Furniture (Shanghai) Co., Ltd., Shanghai Star Furniture Co., Ltd., and Shanghai Xing Ding Furniture Industrial Co., Ltd. (collectively, Starcorp) has a superseding rate from an administrative review for a more recent review period, and is therefore not in the above table.)

Suspension of Liquidation Continues

The ITA will continue the suspension of liquidation of enjoined entries pending the exhaustion of all appellate rights.

In its decision in TimkenCo. v. U.S., the Court of Appeals for the Federal Circuit (CAFC) held that the ITA must publish a notice of a court decision that is not "in harmony" with an ITA determination and must suspend liquidation of entries pending a "conclusive" court decision.
