CV: China Circular Welded Autenitic Stainless Steel Pipe

The International Trade Administration has made a final affirmative countervailing duty determination that countervailable subsidies are being provided to producers and exporters of circular welded austenitic stainless pressure pipe (CWASPP) from China.

CV Liquidation Suspended Through November 6, 2008 (Except Winner)

The ITA will instruct U.S. Customs and Border Protection to continue the suspension of liquidation (and cash deposit/bond requirement) for all entries of CWASPP from China for CV duty purposes that have a time of entry from July 10, 2008 through November 6, 2008 (except for certain entries of CWASPP produced and exported by the Winner Companies, which the ITA found in its amended preliminary determination to have a de minimis rate and was at that point no longer subject to suspension or cash/bonding).

(Note that the Winner Companies' CV duty rate has changed as a result of this final determination, and is once again no longer de minimis.)

CV Liquidation Reinstated, No Cash/Bonding Required as of Nov. 7, 2008

The ITA will issue instructions to CBP to discontinue the suspension of liquidation (and cash deposit/bond requirement) for CV duty purposes for subject merchandise with a time of entry on or after November 7, 2008. Any entries from November 7, 2008 are not liable for CV duties until a CV order (if any) is in effect.

CV Liquidation to be Suspended Again, Cash Deposit, if CV Order Issued

If the ITC issues a final affirmative injury determination, the ITA will issue a CV order, reinstate the CV suspension of liquidation, and require a cash deposit of estimated CV duties for CWASPP entries at the rates listed below (the CV duty rates have changed since the ITA's amended preliminary CV duty determination):

(If the ITC determines that material injury, or threat of material injury, does not exist, this proceeding will be terminated and all estimated duties deposited or securities posted as a result of the suspension of liquidation will be refunded or canceled.)
