CBP Issues Notices on 2009 TPLs for Textiles and Apparel from Canada or Mexico
U.S. Customs and Border Protection has posted separate notices to its Web site which list the calendar year 2009 Tariff Preference Levels for certain textiles and apparel from Canada or Mexico. These 2009 TPLs are set at the same levels as the 2008 TPL levels.

According to CBP, opening day for these 2009 TPLs will be January 2, 2009.
Canadian TPLs. The eight Canada TPLs, which are implemented under HTS Section XI, Additional U.S. Notes (AUSNs) 3, 4, and 5, and operate as tariff-rate quotas (TRQs), are for Canadian textiles and apparel which do not qualify as "originating goods" under the North American Free Trade Agreement (NAFTA) preference rules of origin.
"Non-originating" textiles and apparel from Canada which meet the criteria for the TPLs receive the lower Canada/NAFTA preferential rate of duty on imports into the U.S. until the TPL fills. As of December 1, 2008, none of the Canada TPLs had filled and none were estimated to close early.
A valid Certificate of Eligibility is required when making a TPL claim .The first number of the certificate must match the year of entry summary presentation and the year when release occurs. Therefore, entry summaries for merchandise released on or after December 15, 2008 must be presented by December 31, 2008. If presented after that date, liquidated damages will be assessed for a late file.
Mexican TPLs. The six Mexican TPLs, which are implemented under HTS Section XI AUSNs 3, 4, and 5, and operate as TRQs, are for Mexican textiles and apparel which do not qualify as "originating goods" under the NAFTA preference rules of origin.
"Non-originating" textiles and apparel from Mexico which meet the criteria for the TPLs receive the lower Mexico/NAFTA preferential rate of duty on imports in to the U.S. until the TPL fills. The 2008 Mexico TPLs that filled as of December 1, 2008 were TPLs 1 and 2.
