AD: China Citric Acid and Certain Citrate Salts

The International Trade Administration has made a preliminary affirmative antidumping duty determination that citric acid and certain citrate salts from China are being, or are likely to be, sold in the U.S. at less than fair value.

Combination rates. The ITA has calculated combination rates for certain of the respondents that are eligible for a separate rate. (See ITT's Online Archives or 04/11/05 news, 05041110, for BP summary of an April 2005 policy bulletin outlining this change in practice with regard to combination rates for non-market economies (NMEs).)

Suspension of liquidation. The ITA will instruct U.S. Customs and Border Protection to suspend liquidation of all entries of subject merchandise from China with a time of entry on or after November 20, 2008.

AD Cash Deposit/Bond Instructions

The ITA will instruct CBP to require a cash deposit or the posting of a bond at the AD rates for the exporter/producer combinations listed below, for entries of subject merchandise from China with a time of entry on or after November 20, 2008:

(The ITA notes that it has determined that subject merchandise exported and produced by TTCA Co., Ltd., (a.k.a. Shandong TTCA Biochemistry Co., Ltd.) benefited from an export subsidy. As this firm is also subject to a preliminary countervailing (CV) duty determination, its AD rate below reflects an adjustment for this subsidy1.

The other listed exporter/producer combinations (except for Yixing Union and the China-wide entity) are separate rate respondents. Their rates1, which are averages of TTCA's and Yixing Union's rates, also reflect an adjustment for TTCA's export subsidy. Yixing Union did not benefit from an export subsidy.)

(The ITA notes that for all non-China exporters of subject merchandise that have not received their own rate, the AD duty cash deposit rate will be the rate applicable to the China exporter/producer combination that supplied that non-China exporter.)

Final Determination Postponed, Provisional Measures Extended

The ITA is postponing the final determination and extending provisional measures from a four-month period to not more than six months. Accordingly, the ITA will make its final determination not later than 135 days after November 20, 2008.

Changes to the Scope of the Investigation

The ITA has amended certain sections of the scope of investigation as follows (deleted text is crossed out, added text is underlined; see preliminary determination for the complete scope):

(1) "The scope of this investigation also includes all forms of unrefinedcrude calcium citrate, including dicalcium citrate monohydrate, and tricalcium citrate tetrahydrate, which are intermediate products in the production of citric acid, sodium citrate, and potassium citrate.

(2) The scope of this investigation does not include calcium citrate that satisfies the standards set forth in the United States Pharmacopeia and has been mixed with a functional excipient, such as dextrose or starch, where the excipient constitutes at least 2%, by weight, of the product.

(3) Potassium citrate and crude calcium citrate are classifiable under HTS 2918.15.5000 and 3824.90.9290, respectively.
