Presidential Proclamation Implements July 1st GSP Changes, Etc . (Part II - Final)

On June 30, 2008, President Bush issued Proclamation 8272 to modify duty-free treatment and certain designations under the Generalized System of Preferences and the African Growth and Opportunity Act (AGOA), and make technical changes to the Harmonized Tariff Schedule.

This is Part II, the final part of a two-part series of summaries on Proclamation 8272 and its annexes, and highlights the technical changes to the HTS. See ITT's Online Archives or 07/02/08 news, 08070205, for Part I regarding GSP, etc.).

The technical changes made by this proclamation affect:

DR-CAFTA Duty-Free Cumulation Benefit/TPL for Woven Apparel

Effective with respect to goods that are entered or withdrawn from warehouse for consumption on or after the effective date to be announced by the USTR in the Federal Register, the HTS is modified as follows:

HTS 9822.05.05 (established by Proclamation 8213 for the new duty-free DR-CAFTA cumulation benefit for certain woven apparel) is deleted and the following new provisions are inserted in numerical sequence in Chapter 98, Subchapter XXII:

HTS 9822.05.11. If entered into the customs territory of the United States in aggregate quantities not to exceed the quantitative limit specified in U.S. Note 21(b) to this subchapter. (Free (P))

HTS 9822.05.13. Goods specified in U.S. Note 21(c) to this subchapter. (Free (P))

Conforming change.U.S. Note 21(a) (as established by Proclamation 8213) is modified by deleting HTS 9822.05.05 and by inserting in lieu thereof HTS 9822.05.11 and HTS 9822.05.13.

(U.S. Note 21, among other things, lists the applicable DR-CAFTA cumulation tariff preference level (TPL) and its sublimits, which apply unless the apparel is exempt.

Non-Originating DR-CAFTA Reduced Duty Suits/Trousers

The article description of HTS 9822.05.60 (established by Proclamation 8213 to provide a 2% duty rate reduction for certain non-originating DR-CAFTA suits and trousers) is modified by deleting the phrase "(except goods for boys)" and by inserting in lieu thereof "(for goods for boys only)".

Effective Date for Loss of GSP for Certain Juice from Jamaica

Proclamation 8240's amendment to the "Rates of Duty 1-Special" subcolumn for HTS 2202.90.37 (fortified fruit and vegetable juice mixtures) that deleted the symbol "A" and inserted "A*," is effective for subject goods from Jamaica entered or withdrawn from warehouse for consumption on or after April 17, 2008.
