AD: India Certain Hot-Rolled Carbon Steel Flat Products
The International Trade Administration has issued its final results of the antidumping duty administrative review of certain hot-rolled carbon steel flat products from India for the period of December 1, 2005 through November 30, 2006.

(a) The ITA has calculated an AD duty cash deposit rate of zero for Ispat; a de minimis rate of 0.09% for Tata Steel; and a de minimis rate of 0.24% for JSW. Therefore, no cash deposits will be required; however, they will remain subject to the order;
(b) For previously reviewed or investigated companies other than those covered by this review, the cash deposit rate will be the company-specific rate established for the most recent period;
(c) If the exporter is not a firm covered in this review, a prior review, or the original AD investigation, but the producer is, the cash deposit rate will be the rate established for the most recent period for the manufacturer of the subject merchandise; and
(d) If neither the exporter nor the manufacturer has its own rate, the cash deposit rate will be 38.72%, the all-others rate established in the AD investigation.
Assessment Instructions for the Review Period (12/01/05 - 11/30/06)
The ITA will issue appropriate assessment instructions directly to U.S. Customs and Border Protection (CBP) 15 days after June 5, 2008. The ITA adds that where the rate is above de minimis, it will issue importer-specific assessment instructions for entries of subject merchandise during the period of review.
The ITA states that for entries of subject merchandise during the review period produced by Tata, JSW, Ispat and Essar for which they did not know their merchandise was destined for the U.S., the ITA will instruct CBP to liquidate un-reviewed entries at the all-others rate if there is no rate for the intermediate company(ies) involved in the transaction.
