Proclamation Grants Benefits to Togo, Solomon Islands; Modifies HTS for Certain Juice, Sugar, Yarn and Denim

President Bush has issued Proclamation 8240, which modifies the Harmonized Tariff Schedule to take certain actions under the African Growth and Opportunity Act, the Generalized System of Preferences, and for other purposes, as follows:

Togo Designated as a "Beneficiary" and "Lesser Developed" AGOA Country

The Republic of Togo is designated as an eligible sub-Saharan country and an eligible AGOA beneficiary country, effective for goods entered or withdrawn from warehouse on or after the 30th day after April 17, 2008.

Togo is also determined to be a "lesser developed" beneficiary AGOA country.

Solomon Islands Designated as a "Least Developed" GSP Country

The Solomon Islands is designated as a "least developed" GSP beneficiary country, effective for goods entered or withdrawn from warehouse on or after the 65th day after April 17, 2008.

(Solomon Islands is currently a GSP beneficiary country.)

Jamaica Loses GSP Benefits for Fortified Juice Mixtures

Imports from Jamaica under HTS 2202.90.37 (fortified fruit and vegetable juice mixtures) are losing GSP benefits.

(The effective date of this change is not in the proclamation due to error. The effective date is expected to be either (1) July 1, 2007, for unliquidated entries, or (2) the date of the proclamation, which is April 17, 2008.)

Colombia Gains GSP Benefits for Certain Sugar

Imports from Colombia under HTS 1701.11.05 (raw cane sugar) are regaining GSP benefits.

(The effective date of this change is not in the proclamation due to error. The effective date is expected to be either (1) January 6, 1987, for unliquidated entries, or (2) the date of the proclamation, which is April 17, 2008.)

Corrections for CBTPA and ATPDEA Synthetic Filament Yarn

The tariff numbers for synthetic filament yarn in the following subchapter notes are corrected to further conform the HTS to certain World Customs Organization-recommended changes:

Additional U.S. 3(d) for Chapter 98, Subchapter XX (Caribbean Basin Trade Partnership Act), and

Additional U.S. Note 4(d) to Chapter 98, Subchapter XXI (Andean Trade Promotion and Drug Eradication Act)

(The correct tariff numbers are 5402.11.30, 5402.11.60, 5402.19.30, and 5402.19.60.)

The effective date of these changes is not in the proclamation due to error. The effective date is expected to be either (1) February 3, 2007, for unliquidated entries, or (2) the date of the proclamation, which is April 17, 2008.)

Corrections for AGOA Abundant Supply Provisions and AGOA Denim TPL

The description of the AGOA abundant supply provisions and the tariff numbers for the denim Tariff Preference Level (9819.15.10) and future TPLs are corrected in U.S. Notes 2 and 5 to Chapter 98, Subchapter XIX (African Growth and Opportunity Act Textiles and Apparel), effective for goods entered or withdrawn from warehouse for consumption on or after October 1, 2007.
