U.S. Customs and Border Protection has issued its weekly tariff rate quota and tariff preference level commodity report as of December 10, 2007. This report includes TRQs on various products such as beef, sugar, dairy products, peanuts, cotton, cocoa products, tobacco, certain BFTA, DR-CAFTA, Israel FTA, JFTA, MFTA, SFTA, UAFTA (AFTA) and UCFTA (Chile FTA) non-textile TRQs, etc. Each report also includes the AGOA, ATPDEA, BFTA, DR-CAFTA, CBTPA, Haitian HOPE, MFTA, NAFTA, SFTA, and UCFTA TPLs and TRQs for qualifying apparel and/or other textile articles, the TRQs on worsted wool fabrics, etc. (CBP's weekly TRQ/TPL commodity report, dated 12/10/07, available at http://www.cbp.gov/xp/cgov/import/textiles_and_quotas/commodity/)

2. CBP Updates HTS Numbers for FDA Indicator Flags Effective 12/10

CBP has issued an ABI administrative message announcing that effective December 10, 2007, the following Harmonized Tariff Schedule numbers have been updated with new Food and Drug Administration indicator flags:

CBP recommends that filers query these HTS numbers to get the correct information for their entries.

(FDA has previously explained that FD1 indicates that the article may be subject to FDA jurisdiction, including FDA review under Section 801(a) of the Federal Food Drug and Cosmetic Act (Act). For products not subject to FDA jurisdiction, a filer can "Disclaim" product from FDA 801(a) notification requirements.

FD2 indicates that the article is under FDA jurisdiction and review of entry information by FDA under section 801(a) of the Act will take place. However, the article is not "food" for which Prior Notice information is required.)

3. 2008 TRQs on Certain Agricultural Products from Israel Open January 2

CBP has posted three notices announcing that the 2008 "low-duty" TRQs for agricultural products from Israel (certain butter, fresh or sour cream, dried milk, and peanuts) provided for in HTS Chapter 99, Subchapter VIII, U.S. Notes 3 , 4 and 6, will open on January 2, 2008 with the following low-duty quantities:

According to CBP sources, CBP will soon be issuing notices on additional TRQs for agricultural products from Israel (i.e., cheese and ice cream).
