AD: Vietnam Certain Frozen Warmwater Shrimp

The International Trade Administration has issued its final results of the antidumping duty administrative and new shipper reviews of certain frozen warmwater shrimp from Vietnam for the period of July 16, 2004 through January 31, 2006.

AD Cash Deposit Instructions for a Time of Entry on or after 09/12/07:

(a) The ITA has determined a de minimis AD duty cash deposit rate of 0.00% for Grobest and Fish One, therefore, no cash deposit will be required for these companies, but they remain subject to the order;

(b) For subject merchandise exported by Grobest but not manufactured by Grobest, the AD duty cash deposit rate will continue to be the Vietnamese-wide entity rate (i.e., 25.76%);

(c) For previously investigated or reviewed Vietnamese and non-Vietnamese exporters not listed above that have separate rates, the AD duty cash deposit rate will continue to be the exporter-specific rate published for the most recent period;

(d) For all Vietnamese exporters of subject merchandise which have not been found to be entitled to a separate rate, the cash deposit rate will be the Vietnamese-wide rate of 25.76%; and

(e) For all non-Vietnamese exporters of subject merchandise which have not received their own rate, the AD duty cash deposit rate will be the rate applicable to the Vietnamese exporters that supplied that non-Vietnamese exporter.

2The Vietnam-wide entity includes, but is not limited to, Aquatic Products Trading Company, Seaprodex Hanoi, Kien Giang Sea Products Import-Export Company (Kisimex), Nha Trang Company Limited, Nha Trang Fisheries Co. Ltd., Seaprodex, Sea Products Imports & Exports, Song Huong ASC Import-Export Company Ltd., Song Huong ASC Joint Stock Company, Viet Nhan Company, and V N Seafoods.

Assessment Instructions for the Review Period (07/16/04 - 01/31/06)

The ITA states that it intends to issue assessment instructions to U.S. Customs and Border Protection 15 days after September 12, 2007.

The ITA adds that it will calculate importer-specific (or customer) assessment rates, and will instruct CBP to assess AD duties on all appropriate entries covered by this review if any importer-specific assessment rate calculated in the final results of this review is above de minimis.
