AD: China Brake Rotors

The International Trade Administration has issued its final results of the antidumping duty administrative and new shipper reviews of brake rotors from China for the period of April 1, 2005 through March 31, 2006.

(a) The ITA has determined de minimis AD duty cash deposit rates for Winhere (0.03%), Meita (0.00%), and for subject merchandise manufactured and exported by Golrich (0.00%), therefore, no cash deposit will be required for these companies, but they remain subject to the order;

(b) The AD duty cash deposit rate for previously investigated or reviewed China and non-China exporters who received a separate rate in a prior segment of the proceeding (which were not reviewed in this segment of the proceeding) will continue to be the rate assigned in that segment of the proceeding;

(c) The AD duty cash deposit rate for all China exporters of subject merchandise that have not been found to be entitled to a separate rate (including Rotec and Hengtai) will be the China-wide entity rate of 43.32%; and

(d) The AD duty cash deposit rate for all non-China exporters of subject merchandise which have not received their own rate will be the rate applicable to the China exporter that supplied that non-China exporter.

2The China-wide entity includes Qingdao Rotec Auto Parts Co., Ltd. (Rotec) and Xiangfen Hengtai Brake System Co., Ltd. (Hengtai), as Rotec and Hengtai did not qualify for separate rates in this administrative review.

Assessment Instructions for the Review Period (04/01/05 - 03/31/06)

The ITA states that it intends to issue assessment instructions to U.S. Customs and Border Protection (CBP) 15 days after August 2, 2007.

The ITA states that for Winhere, Meita, Haimeng, and Golrich, it calculated an exporter/importer (or customer)-specific assessment rate for the merchandise subject to these reviews.

Where an importer (or customer)-specific ad valorem rate is greater than de minimis, the ITA will apply the assessment rate to the entered value of the importer's/customer's entries during the review period. Where an importer (or customer)-specific ad valorem rate is zero or de minimis, the ITA will instruct CBP to liquidate appropriate entries without regard to AD duties. Where the ITA does not have entered values for all U.S. sales, it calculated a per-unit assessment rate.

For the 12 companies receiving a separate rate that were not selected for individual review, the ITA will calculate an assessment rate based on the weighted average of the cash deposit rates calculated for the companies selected for individual review excluding any that are zero, de minimis, or based entirely on adverse facts available (AFA).
