FMCSA Proposes Annual Fees for Commercial Motor Vehicles Under Unified Carrier Registration Agreement

The Federal Motor Carrier Safety Administration has issued a proposed rule which would add a new Subpart B to 49 CFR Part 367 to establish annual fees and a fee bracket structure for the Unified Carrier Registration (UCR) Agreement as required under the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU).

Comments must be submitted by June 13, 2007.

(The UCR Agreement is an interstate agreement governing the collection and distribution of registration and financial responsibility information provided and fees paid by motor carriers, motor private carriers, freight forwarders, brokers, and leasing companies.

The purpose of the UCR Agreement is both to replace the outdated Single State Registration System (SSRS), which expired on January 1, 2007, for registration of interstate motor carrier entities with the states and to ensure that states don't lose current revenues derived from the SSRS.

The UCR Agreement statute provides for a 15-member Board of Directors to be appointed by the Secretary of Transportation. Among its responsibilities, the Board must submit to the Secretary of Transportation a recommendation for the initial annual fees to be assessed motor carriers, motor private carriers, freight forwarders, brokers and leasing companies under the UCR Agreement. FMCSA is then directed to set the fees within 90 days after receiving the Board's recommendation and after notice and opportunity for public comment.)

FMCSA Proposes Fees Based on Number of Vehicles Owned or Operated, Etc.

According to the FMCSA, the proposed fees for registration year 2007 are based on the number of commercial motor vehicles owned or operated by motor carriers, motor private carriers, and freight forwarders, as follows:
