AD: China Certain Cased Pencils

The International Trade Administration has issued its final results of the antidumping duty administrative review of certain cased pencils from China for the period of December 1, 2004 through November 30, 2005.

(a) For any previously reviewed or investigated China or non-China exporter, not covered in this review, with a separate rate, the AD duty cash deposit rate will be the company-specific rate established in the most recent segment of this proceeding;

(b) For all other China exporters, the AD duty cash deposit rate will be the China-wide rate, which is 114.9%; and

(c) The AD duty cash deposit rate for any non-China exporter of subject merchandise from China will be the rate applicable to the China exporter that supplied that exporter.

Assessment Instructions for the Review Period (12/01/04 - 11/30/05)

The ITA states that it intends to issue assessment instructions to U.S. Customs and Border Protection 15 days after May 14, 2007.

Additionally, the ITA states that it calculated customer-specific duty assessment rates for CFP/Three Star. Where the customer-specific assessment rate is above de minimis, the ITA states that it will instruct CBP to assess the customer-specific AD rate uniformly on the entered customs value of all review period entries of subject merchandise sold to the customer.

For Dixon and Shandong Rongxin, the ITA states that it will instruct CBP to assess AD duties on entries of merchandise from these companies equal to the dumping margin these companies have received in these final results of review, regardless of the importer of, or customer who purchased, the subject merchandise.
