Some Chapter 99 Underlying Tariff Numbers are Only Updated for WCO Changes in CBP's HS System (Not in ITC's Printed or Online HTS)

According to sources at the International Trade Commission (ITC) and U.S. Customs and Border Protection (CBP), some of the underlying tariff numbers for 2007 Chapter 99 tariff numbers are more up-to-date in CBP's Automated Broker Interface (ABI) records and Harmonized records, than in the ITC's electronic and print version of the 2007 Harmonized Tariff Schedule.

ABI and Harmonized records: New Chapter 99 underlying tariff nos already updated for WCO changes. CBP sources state that updates to its ABI and Harmonized records were announced on February 2, 2007 for the underlying tariff numbers of the new HTS Chapter 99 tariff numbers added by the Tax Relief and Health Care Act of 2006 (P.L. 109-432).

These updates were necessary to conform the underlying Chapter 1-97 tariff numbers to amendments contained in Proclamation 8097, which amended the HTS to implement certain World Customs Organization (WCO)-recommended tariff changes.

(CBP sources note that such updates are a 'work in progress' as CBP can only update those tariff numbers that it is aware of as needing an update (i.e., some tariff numbers may still need updating).)

Online and print HTS: New Chapter 99 underlying tariff nos not updated for WCO changes. ITC sources state that it has not yet updated its online and printed February 3, 2007 "Basic Edition" HTS for the underlying Chapter 1-97 tariff numbers of the new HTS Chapter 99 tariff numbers added by the Tax Relief and Health Care Act of 2006.

According to ITC sources, a proclamation must first be issued before the ITC can update its 2007 electronic and paper versions for the WCO-recommended tariff changes for these underlying tariff numbers.

Trade sources add that even after a proclamation is issued, it may take additional time for the ITC to update its electronic and print versions of the HTS, as they are not updated regularly. (The online version is updated more frequently than the printed version.)

(ITC sources note that other Chapter 99 tariff numbers may also need similar WCO updating. BP will update readers with additional details when available.)
