ITC Issues Final Report on Proposed HTS Changes for January 1, 2007 (Part XXXI - HTS Chapters 91-94)

The International Trade Commission (ITC) has issued a final report to the President in connection with its investigation of proposed modifications to the Harmonized Tariff Schedule (HTS) that are expected to take effect on January 1, 2007.

This final report, entitled, Proposed Modifications to the Harmonized Tariff Schedule of the U.S., is part of ITC investigation number 1205-6 which was instituted in September 2004, in conjunction with the third review cycle of the International Convention on the Harmonized Commodity Description and Coding System (HS).

This is Part XXXI of a multi-part series of summaries on the ITC's final report. Part XXXI highlights the proposed changes to HTS Chapters 91 through 94 as set forth in Appendix B. See ITC report for duty rates. See future issues of ITT for additional summaries.

Proposed Changes to HTS Chapter 91 through 94

Appendix B of the ITC final report sets forth the following proposed changes for HTS Chapters 91 through 94 (partial list; see report for complete details):

Chapter 91:Clocks and watches and parts thereof

  1. 1.12 through 9101.12.80 would be deleted
  2. 1.19.20 would be added
  3. 6.20.00 would be deleted
  4. 6.90.20 would be added

Chapter 92:Musical instruments; parts and accessories of such articles

  1. 3 and 9204 and their subheadings would be deleted

the article description of 9205 would be amended to read as follows (deleted text is denoted by <->):

"<Other> wind musical instruments (for example, clarinets, trumpets, bagpipes):"

  1. 5.90.10, 9205.90.14, 9205.90.15, 9205.90.18 and 9205.90.19 would be added
  2. 9.10.00, 9209.20.00 and 9209.93 through 9209.93.80 would be deleted
  3. 9.99.05, 9209.99.16 and 9209.99.18 would be added
  4. 9.99.60 would be renumbered as 9209.99.61

Chapter 93:Arms and ammunition; parts and accessories thereof

  1. 6.10.00 would be deleted
  2. 6.30.40 would be renumbered as 9306.30.41

Chapter 94:Furniture; bedding, mattresses, mattress supports, cushions and similar stuffed furnishings; lamps and lighting fittings, not elsewhere specified or included; illuminated signs, illuminated nameplates and the like; prefabricated buildings

new Additional U.S. Note 1 would be added and would read as follows:

"1. For the purposes of subheading 9401.20.00, "seats of a kind used for motor vehicles" does not include child safety seats."

  1. 1.50.00 would be superseded by the following superior text and tariff numbers: Seats of cane, osier, bamboo or similar materials:, 9401.51.00 and 9401.59.00
  2. 3.80 through 9403.80.60 would be superseded by the following superior text and tariff numbers: Furniture of other materials, including cane, osier, bamboo or similar materials:, 9403.81.00, 9403.89, 9403.89.30 and 9403.89.60
