ITC Issues Final Report on Proposed HTS Changes for January 1, 2007 (Part XXIX - HTS Section XVII - Chapter 88)

The International Trade Commission (ITC) has issued a final report to the President in connection with its investigation of proposed modifications to the Harmonized Tariff Schedule (HTS) that are expected to take effect on January 1, 2007.

This final report, entitled, Proposed Modifications to the Harmonized Tariff Schedule of the U.S., is part of ITC investigation number 1205-6 which was instituted in September 2004, in conjunction with the third review cycle of the International Convention on the Harmonized Commodity Description and Coding System (HS).

This is Part XXIX of a multi-part series of summaries on the ITC's final report. Part XXIX highlights the proposed changes to HTS Section XVII through Chapter 88 as set forth in Appendix B. See ITC report for duty rates. See future issues of ITT for additional summaries.

Proposed Changes to HTS Section XVII through Chapter 88

Appendix B of the ITC final report sets forth the following proposed changes for HTS Section XVII through Chapter 88 (partial list; see report for complete details):

Section XVII:Vehicles, aircraft, vessels and associated transport equipment

Note 1 to Section XVII would be amended to read as follows (deleted text is denoted by <->):

"1. This section does not cover articles of heading <9501,> 9503 or 9508, or sleds, bobsleds, toboggans or the like of heading 9506."

Chapter 86:Railway or tramway locomotives, rolling-stock and parts thereof; railway or tramway track fixtures and fittings and parts thereof; mechanical (including electro-mechanical) traffic signaling equipment of all kinds

  1. 6.20.00 would be deleted

the article description of 8606.30.00 would be amended to read as follows (deleted text is denoted by <->):

"Self-discharging cars, other than those of subheading 8606.10 <or 8606.20>"

  1. 6.99.00 would be renumbered as 8606.99.01

Chapter 87:Vehicles other than railway or tramway rolling stock, and parts and accessories thereof

Note 4 to Chapter 87 would be amended to read as follows (deleted text is denoted by <->; added text is denoted by ):

"4. Heading 8712 includes all children's bicycles. Other children's cycles fall in heading 9503 <9501>."

  1. 8.31 through 8708.39.50 and the superior text immediately preceding these subheadings would be superseded by the following: 8708.30, 8708.30.10 and 8708.30.50
  2. 8.40 through 8708.60.80 would be superseded by the following: 8708.40, 8708.40.11, 8708.40.30, 8708.40.50, 8708.40.60, 8708.40.65, 8708.40.70, 8708.40.75, 8708.50, 8708.50.11, 8708.50.31, 8708.50.51, 8708.50.61, 8708.50.65, 8708.50.70, 8708.50.75, 8708.50.79, 8708.50.81, 8708.50.85, 8708.50.89, 8708.50.91, 8708.50.93, 8708.50.95 and 8708.50.99

  5. 8.94 through 8708.94.50 would be superseded by the following: 8708.94, 8708.94.10, 8708.94.50, 8708.94.60, 8708.94.65, 8708.94.70 and 8708.94.75
  6. 8.95, 8708.95.05, 8708.95.10, 8708.95.15 and 8708.95.20 would be added
  7. 8.29.10, 8708.99.09, 8708.99.12, 8708.99.18, 8708.99.21, 8708.99.34, 8708.99.37, 8708.99.43, 8708.99.46, 8708.99.61, 8708.99.64, 8708.99.70 and 8708.99.73 would be deleted.
  8. 8.99.24, 8708.99.49 and 8708.99.80 would be renumbered as 8708.99.23, 8708.99.48 and 8708.99.81, respectively.

Chapter 88:Aircraft, spacecraft, and parts thereof

  1. 1 and subheadings 8801.10.00 and 8801.90.00 would be superseded by the following: 8801.00.00
