AD: France Low Enriched Uranium

The International Trade Administration (ITA) has issued the final results of its antidumping (AD) duty administrative review of low enriched uranium from France for the period of February 1, 2004 through January 31, 2005.

(a) For producers or exporters not covered in this review but covered in a previous segment of this AD proceeding, the AD cash deposit rate will continue to be the company-specific rate published in the most recent final results in which that producer or exporter participated;

(b) If the exporter is not a firm covered in this review or any previous segment of this AD proceeding, but the producer is, the AD duty cash deposit rate will be the rate established for the producer of the merchandise in these final results of review or in the most recent final results in which the producer participated; and

(c) If neither the exporter nor the producer is a firm covered in this review or any previous segment of this AD proceeding, the AD duty cash deposit rate will be 19.95%, the "all others" rate established in the AD investigation.

Assessment Instructions for the Review Period (02/01/04 - 01/31/05)

The ITA states that it will not issue liquidation instructions for any entries of Eurodif merchandise until such time as the July 1, 2002 injunction issued by the Court of International Trade is lifted.

The ITA adds that in situations where the reviewed company did not know their merchandise was destined for the U.S., the ITA will instruct U.S. Customs and Border Protection (CBP) to liquidate such unreviewed entries at the "all others" rate if there is no rate for the intermediate company involved in the transaction.
