ITC Issues Final Report on Proposed HTS Changes for January 1, 2007 (Part XI - HTS Chapters 39-43)

The International Trade Commission (ITC) has issued a final report to the President in connection with its investigation of proposed modifications to the Harmonized Tariff Schedule (HTS) that are expected to take effect on January 1, 2007.

This final report, entitled, Proposed Modifications to the Harmonized Tariff Schedule of the U.S., is part of ITC investigation number 1205-6 which was instituted in September 2004, in conjunction with the third review cycle of the International Convention on the Harmonized Commodity Description and Coding System (HS).

This is Part XI of a multi-part series of summaries on the ITC's final report. Part XI highlights the proposed changes to HTS Chapters 39 through 43 as set forth in Appendix B. See future issues of ITT for additional summaries.

Proposed Changes to HTS Chapters 39 through 43

Appendix B of the ITC final report sets forth the following proposed changes for HTS Chapters 39 through 43 (see report for complete details):

Chapter 39:Plastics and articles thereof

note 2 to chapter 39 would be amended by:

- redesignating present subparagraphs (a) through (f) as (b) through (g), respectively
- adding a new subparagraph (a)
- redesignating present subparagraphs (g) through (w) as (k) through (z), respectively
- adding new subparagraphs (h) and (ij)

subheading note 1(a)(1) to chapter 39 would be amended by deleting "e.g.," and substituting "for example,"

new Additional U.S. Note 5 would be added

  1. 7.70.00 would be added
  2. 7.99.00 would be renumbered as 3907.99.01
  3. 0.72.00 would be deleted
  4. 0.79.10 and 3920.79.50 would be superseded by 3920.79.05, 3920.79.10 and 3920.79.50

article description of 3924 would be superseded by "Tableware, kitchenware, other household articles and hygienic or toilet articles, of plastics:"

  1. 4.90.05 would be added
  2. 6.90.15 would be renumbered as 3926.90.16 and the article description of that subheading would be amended to read as "Pacifiers"
  3. 6.90.20 would be renumbered as 3926.90.21 and the article description of that subheading would be amended to read as "Ice bags, douche bags, enema bags, hot water bottles, and fittings therefor; invalid and similar nursing cushions; dress shields; pessaries; prophylactics; bulbs for syringes; syringes (other than hypodermic syringes) and fittings therefor, not in part of glass or metal"
  4. 6.90.48 would be added
  5. 4.90.55 would be renumbered as 3924.90.56

Chapter 40: Rubber and articles thereof

note 4(a) to chapter 40 would be amended by deleting "note 5(b)(ii) and (iii)" and substituting 5(B)(ii) and (iii)"

notes 5(a) and 5(b) would be relettered as 5(A) and 5(B), respectively

note 5(a)(iii) (relettered as 5(A)(iii)) would be amended by deleting "permitted under (b)" and substituting "permitted under (B)"

  1. 0.13.00 would be deleted
  2. 0.19.90 would be renumbered as 4010.19.91

Chapter 41: Raw hides and skins (other than furskins) and leather

note 1(c) to chapter 41 would be amended by deleting the expression "of gazelle," and substituting "of gazelle, of camels (including dromedaries),"

  1. 3.10 through 4103.10.30 would be deleted
  2. 3.90.10 would be renumbered as 4103.90.11
  3. 3.90.20 would be superseded by 4103.90.12, 4103.90.13 and 4103.90.20

Chapter 42: Articles of leather; saddlery and harness; travel goods, handbags and similar containers; articles of animal gut (other than silkworm gut)

  1. 4.00, 4204.00.30 and 4204.00.60 would be deleted
  2. 5.00.20 through 4205.00.80 would be superseded by 4205.00.05, 4205.00.10, 4205.00.20, 4205.00.40, 4205.00.60 and 4205.00.80
  3. 6 and 4206.10 through 4206.90.00 would be superseded by 4206.00, 4206.00.13, 4206.00.19 and 4206.00.90

Chapter 43:Furskins and artificial fur; manufactures thereof

  1. 1.70.00 would be deleted
  2. 1.80.01 would be renumbered as 4301.80.02
  3. 2.13.00 would be deleted
  4. 2.19.13 would be added
