ITC Issues Final Report on Proposed HTS Changes for January 1, 2007 (Part X)

This final report, entitled, Proposed Modifications to the Harmonized Tariff Schedule of the U.S., is part of ITC investigation number 1205-6 which was instituted in September 2004, in conjunction with the third review cycle of the International Convention on the Harmonized Commodity Description and Coding System (HS).

This is Part X of a multi-part series of summaries on the ITC's final report. Part X highlights the proposed changes to HTS Chapters 30 through 38 as set forth in Appendix B. See future issues of ITT for additional summaries.

Proposed Changes to HTS Chapters 30 through 38

Appendix B of the ITC final report sets forth the following proposed changes for HTS Chapters 30 through 38 (see report for complete details):

Chapter 30:Pharmaceutical products

note 4(a) to chapter 30 would be superseded by "(a) Sterile surgical catgut, similar sterile suture materials (including sterile absorbable surgical or dental yarns) and sterile tissue adhesives for surgical wound closure;"

note 4(c) to chapter 30 would be superseded by "(c) Sterile absorbable surgical or dental hemostatics; sterile surgical or dental adhesion barriers, whether or not absorbable;"

note 4(ij) to chapter 30 would be amended by deleting the word "and" at the end of that subparagraph

note 4(k) to chapter 30 would be amended by deleting the period at the end and substituting the expression"; and"

note 4(l) would be added

1. 1.10.00 would be deleted
2. 1.90.00 would be renumbered as 3001.90.01

article description of 3004.32.00 would be amended by replacing "and" by "or"

1. 6.10.00 would be renumbered as 3006.10.01 and the text of that subheading would be superseded by "Sterile surgical catgut, similar sterile suture materials (including sterile absorbable surgical or dental yarns) and sterile tissue adhesives for surgical wound closure; sterile laminaria and sterile laminaria tents; sterile absorbable surgical or dental hemostatics; sterile surgical or dental adhesion barriers, whether or not absorbable"
2. 6.80.00 would be superseded by 3006.91.00 and 3006.92.00

Chapter 31:Fertilizers

1. 2.70.00 would be deleted
2. 2.90.00 would be renumbered as 3102.90.01
3. 3.20.00 would be deleted
4. 3.90.00 would be renumbered as 3103.90.01
5. 4.10.00 would be deleted
6. 4.90.00 would be renumbered as 3104.90.01

Chapter 32: Tanning or dyeing extracts; dyes, pigments, paints, varnishes, putty and mastics

1. 6.30.00 and 3206.43.00 would be deleted
2. 6.49.50 would be superseded by 3206.49.55 and 3206.49.60

Chapter 33: Essential oils and resinoids; perfumery, cosmetic or toilet preparations

1. 1.11.00 and 3301.14.00 would be deleted
2. 1.19.50 would be renumbered as 3301.19.51
3. 1.21.00, 3301.22.00, 3301.23.00 and 3301.26.00 would be deleted
4. 1.29.50 would be renumbered as 3301.29.51

Chapter 34: Soap, organic surface-active agents, washing preparations, lubricating preparations, artificial waxes, prepared waxes, polishing or scouring preparations, candles and similar articles, modeling pastes, "dental waxes" and dental preparations with a basis of plaster

1. 4.10.00 would be deleted
2. 4.90.50 would be renumbered as 3404.90.51

Chapter 37:Photographic or cinematographic goods

1. 2.20.00 would be deleted

the subheading numbers in the left column of the table would be renumbered as the corresponding numbers in the right column, respectively

1. 5.20, 3705.20.10 and 3705.20.50 would be deleted
2. 5.90.00 would be renumbered as 3705.90.01

Chapter 38: Miscellaneous chemical products

note 1(c) to chapter 38 would be amended by replacing "Ash" by "Slag, ash"

title "Subheading Note" would be replaced by "Subheading Notes"

new subheading note 1 would be added

present subheading note 1 would be renumbered as subheading note 2

1. 5.20.00 would be deleted
2. 5.90.00 would be superseded by 3805.90, 3805.90.10 and 3805.90.50

3. 4.71.00 and 3824.79.00 and the superior text immediately preceding these subheadings would be superseded by 3824.71.01, 3824.72.00, 3824.73.00, 3824.74.00, 3824.75.00, 3824.76.00, 3824.77.00, 3824.78.00, 3824.79, 3824.79.10 and 3824.79.90
4. 4.81.00, 3824.82.00 and 3824.83.00 would be added
