ITC Issues Final Report on Proposed HTS Changes for January 1, 2007 (Part IX)

The International Trade Commission (ITC) has issued a final report to the President in connection with its investigation of proposed modifications to the Harmonized Tariff Schedule (HTS) that are expected to take effect on January 1, 2007.

This final report, entitled, Proposed Modifications to the Harmonized Tariff Schedule of the U.S., is part of ITC investigation number 1205-6 which was instituted in September 2004, in conjunction with the third review cycle of the International Convention on the Harmonized Commodity Description and Coding System (HS).

This is Part IX of a multi-part series of summaries on the ITC's final report. Part IX highlights the proposed changes to HTS Chapter 29 as set forth in Appendix B. See future issues of ITT for additional summaries.

Proposed Changes to HTS Chapter 29

Appendix B of the ITC final report sets forth the following proposed changes for HTS Chapter 29 (see report for complete details):

Chapter 29:Organic Chemicals

notes 5(a), 5(b), 5(c), 5(d) and 5 (e) to chapter 29 would be relettered as 5(A), 5(B), 5(C), 5(D) and 5 (E), respectively

note 5(c)(1) (relettered as 5(C)(1)) would be amended by deleting the word "and" at the end of the subparagraph

note 5(c)(2) (relettered as 5(C)(2)) would be amended by deleting the period at the end of the subparagraph and substituting "; and"

note 5(C)(3) would be added

the first paragraph of note 6 to chapter 29 would be superseded by "The compounds of headings 2930 and 2931 are organic compounds the molecules of which contain, in addition to atoms of hydrogen, oxygen or nitrogen, atoms of other nonmetals or of metals (such as sulfur, arsenic or lead) directly linked to carbon atoms."

in the notes to chapter 29, the term "Subheading Note" would be amended to read "Subheading Notes"

subheading note 2 would be added

article description of 2903.15.00 would be superseded by "Ethylene dichloride (ISO) (1,2-dichloroethane)"

  1. 3.30 and 2903.30.05 through 2903.30.20 would be superseded by 2903.31.00, 2903.39, 2903.39.15 and 2903.39.20

article description of 2903.51.00 would be superseded by "1,2,3,4,5,6-Hexachlorocyclohexane (HCH (ISO)), including lindane (ISO,INN)"

  1. 3.52.00 would be added
  2. 3.59.10 would be renumbered as 2903.59.11

article description of 2903.62.00 would be superseded by "Hexachlorobenzene (ISO) and DDT (ISO) (clofenotane (INN), 1,1,1-trichloro-2,2-bis(p-chlorophenyl)ethane)"

  1. 5.15.00 would be deleted
  2. 5.19.00 would be superseded by 2905.19, 2905.19.10 and 2905.19.90
  3. 6.14.00 would be deleted
  4. 6.19.30 would be added
  5. 7.14.00 would be deleted
  6. 7.19.60 would be superseded by 2907.19.61
  7. 8.10 and 2908.10.05 through 2908.10.60 would be superseded by 2908.11.00, 2908.19, 2908.19.05, 2908.19.10, 2908.19.15, 2908.19.20, 2908.19.25. 2908.19.35 and 2908.19.60
  8. 8.20 and 2908.20.04 through 2908.20.60 would be deleted
  9. 8.90 and 2908.90.04 through 2908.90.50 would be superseded by 2908.91.00, 2908.99, 2908.99.03, 2908.99.06, 2908.99.09, 2908.99.12, 2908.99.15, 2908.99.20, 2908.99.25, 2908.99.30, 2908.99.35, 2908.99.40, 2908.99.80 and 2908.99.90
  10. 9.42.00 would be deleted
  11. 9.49.60 would be renumbered as 2909.49.61
  12. 0.40.00 would be added
  13. 0.90.50 would be renumbered as 2910.90.90
  14. 2.13.00 would be deleted
  15. 2.19.25 would be added
  16. 5.22.00 and 2915.23.00 would be deleted
  17. 5.29.20 and 2915.29.30 would be added

  29. 9.00 and 2919.00.15 through 2919.00.50 would be superseded by 2919, 2919.10.00, 2919.90, 2919.90.15, 2919.90.25, 2919.90.30 and 2919.90.50
  30. 0.10 and 2920.10.10 through 2920.10.50 would be superseded by 2920.11.00, 2920.19, 2920.19.10, 2920.19.40 and 2920.19.50
  31. 1.12.00 would be deleted
  32. 1.19.10 would be renumbered as 2921.19.11 and the article description of that subheading would be superseded by "Mono-, di- and triethylamines; mono-, di- and tri-(propyl- and butyl-)monoamines; salts of any of the foregoing"
  33. 2.22 and 2922.22.10 through 2922.22.50 would be deleted
  34. 2.29.03 would be added
  35. 2.29.60 and 2922.29.80 would be renumbered as 2922.29.61 and 2922.29.81, respectively
  36. 4.12.00 would be added
  37. 4.19.10 would be renumbered as 2924.19.11
  38. 5.20 and 2925.20.10 through 2925.20.90 would be superseded by 2925.21.00, 2925.29, 2925.29.10, 2925.29.18, 2925.29.20, 2925.29.60, 2925.29.70 and 2925.29.90
  39. 0.10.00 would be deleted
  40. 0.90.90 would be renumbered as 2930.90.91
  41. 0.50.00 would be added
  42. 0.90.44 would be renumbered as 2930.90.43
  43. 6.10.00 would be deleted
  44. 6.90.00 would be renumbered as 2936.90.01 and the article description of that subheading would be superseded by "Other, including provitamins and natural concentrates"
  45. 9.21.00 and 2939.29.00 and the superior text immediately preceding these subheadings would be superseded by 2939.20.00
