AD: China Fresh Garlic

The International Trade Administration (ITA) has issued the final results of its antidumping (AD) duty administrative and new shipper reviews of fresh garlic from China for the period of November 1, 2003 through October 31, 2004.

AD duty new shipper review

San Li was referred to as Henan Xiancheng Sunny Foodstuff Factory in the initiation of the new shipper review.

The China wide rate includes the following companies that the ITA found did not qualify for a separate rate: Pizhou Guangda Import and Export Co., Ltd., H&T Trading Company, Jinxiang Hongyu and Storing Co., Ltd., Jining Yun Feng Agriculture Products Co., Ltd., Clipper Manufacturing Ltd., and Heze Ever-Best International Trade Co., Ltd.

(a) An AD duty rate of zero exists; however, suspension of liquidation will continue;

(b) The AD duty rate is de minimis for Dongyun (0.29%) and Harmoni (0.27%). As a result, no AD cash deposit is required; however, suspension of liquidation will continue;

(c) For previously reviewed or investigated companies not listed above that have separate rates, the AD cash deposit rate will continue to be the company-specific rate published for the most recent period;

(d) For all other China exporters of subject merchandise which have not been found to be entitled to a separate rate, the AD cash deposit rate will be the China-wide rate of 376.67%; and

(e) For all non-China exporters of subject merchandise, the AD cash deposit rate will be the rate applicable to the China exporter that supplied that exporter.

Assessment Instructions for the Review Period (11/01/03 - 10/31/04)

The ITA states that it will issue appropriate assessment instructions directly to U.S. Customs and Border Protection (CBP) within 15 days of May 4, 2006.

Additionally, the ITA states that it has calculated importer- or customer-specific AD duty assessment rates, which trade sources note may differ significantly from the AD cash deposit rates listed above (which are weighted averages).

Bonding No Longer Permitted for Certain Entries of Fresh Garlic from China

Lastly, the ITA notes that bonding will no longer be permitted to fulfill security requirements for shipments of fresh garlic from China produced by San Li and exported by Shanghai LJ, and produced and exported by Qingyuan that are entered, or withdrawn from warehouse, for consumption on or after May 4, 2006.
